One of the many benefits of membership with LITDA is our legislative involvement. Through the diligent work of our Government Relations team at The Tatman Group, bills are carefully monitored throughout the legislative session to ensure that our industry and the customers we serve are protected. LITDA members are provided with regular updates and alerts about the session, new state and national legislation, and how it affects your business and our industry. LITDA has had many successes over the years because of our legislative involvement and the hard work of our leaders and members.
Tire & Wheel Coverage
In 2018, the LITDA worked to amend legislation that would have forced all tire dealers to use third-party insurers for tire & wheel coverage. This would have fundamentally changed the business operations for tire dealers across the state. LITDA was able to amend the provision out of the bill in order to protect Louisiana's tire dealers.
Road Hazard Coverage
In 2010, the Louisiana Independent Tire Dealers Association passed legislation to clarify that the sale of road hazard coverage did not constitute the sale of insurance under the law and that tire salespeople did not have to have an insurance agents’ license in order to sell road hazard protection to customers when purchasing tires from a tire dealer. HB 581 corrected a problem caused by Louisiana Department of Insurance Bulleting 09-14 which required anyone who sold road hazard coverage for a tire in Louisiana to be licensed as a property and casualty insurance agent. It further required anyone who had in-house road hazard coverage to be licensed as a property and casualty insurance company. The Louisiana Tire Dealers Association worked to get a temporary injunction to halt that bulletin and then to pass legislation that make it clear that road hazard coverage was not insurance.
Every year, the Louisiana Waste Tire Program is debated in the Louisiana Legislature. The LITDA stands up for the independent tire dealers to ensure that the burden of enforcement does not fall on our members and that there are no fee increases or changes that would adversely impact our members. For the past decade, the LITDA has been a prominent player in the debate over the Louisiana Waste Tire Program. We work to protect our members’ throughout the legislative process.
